Terms of Service

Important: KidsGPT is intended for use only by parents or legal guardians on behalf of children aged 4–12. By creating an account or allowing your child to use the KidsGPT application (the “Service”), you agree to these Terms and provide the consent described in the Parental Consent Notice below.

1. Acceptance of Terms

By tapping “I Agree,” installing, or using the Service, you (“Parent,” “you”) enter into a legally binding agreement with KidsGPT (“KidsGPT,” “we,” “our”). If you do not agree, do not use the Service.

2. Eligibility

You affirm that you are at least 18 years old and the legal guardian of each child whose data you provide. Children must not create their own accounts.

3. License

KidsGPT grants you a limited, non‑exclusive, non‑transferable, revocable licence to access and use the Service for personal, non‑commercial educational purposes, subject to these Terms.

4. Parent Responsibilities

  • Supervise your child’s use of the Service.

  • Keep login credentials secure.

  • Review all content generated with or for your child.

  • Use the parental dashboard to manage filters, data‑retention settings, and consents.

5. User & Child Content

The Service lets your child speak or type prompts and may generate text or images (“AI Content”).

  • You own any original material your child provides.

  • KidsGPT owns or licenses the AI models and grants you a licence to use AI Content created for you.

  • You may share AI Content privately; do not publish it if it contains personal info of your child or others.

6. Prohibited Conduct

You agree not to:

  1. Attempt to obtain personal information from other children.

  2. Upload real photographs of children for remix or transformation.

  3. Use the Service to generate or distribute harmful, illegal, or discriminatory content.

  4. Reverse‑engineer or interfere with security features.

7. Privacy

Our Privacy Policy explains what personal information we collect, how we use it, and your rights under Canada’s PIPEDA / Law 25 and New Zealand’s Privacy Act 2020. These Terms incorporate the Privacy Policy by reference.

8. Fees

The MVP Service is offered free of charge. If we introduce paid features, we will notify you and amend these Terms.

9. Termination

You may delete your account at any time via the dashboard or by emailing privacy@kidsgpt.club. KidsGPT may suspend or terminate access if you breach these Terms or if required by law.

10. Disclaimer of Warranties

The Service is provided “as is” without warranties of any kind. We do not warrant that the Service will be uninterrupted or error‑free or that AI Content will meet your expectations.

11. Limitation of Liability

To the maximum extent permitted by applicable law, KidsGPT is not liable for indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our aggregate liability will not exceed the greater of CAD 100 or NZD 100.

12. Indemnity

You agree to indemnify and hold KidsGPT harmless from claims or losses arising from your breach of these Terms or misuse of the Service.

13. Governing Law

  • If you reside in Canada, these Terms are governed by the laws of your province of residence and the federal laws of Canada.

  • If you reside in New Zealand or elsewhere, these Terms are governed by New Zealand law.
    Any dispute will be subject to the exclusive jurisdiction of the courts in the relevant region.

14. Changes to Terms

We may modify these Terms. We will give at least 30 days’ notice by email to verified parents for material changes. Continued use after the effective date constitutes acceptance.
